TERMS & CONDITIONS 

These Terms and Conditions ("Agreement") create a contract between you and PATHFINDER LP ("Company"), a company situated in Mumbai, India, and govern your use of the ROHFIT mobile application ("ROHFIT"), owned and operated by the Company. By accessing or using ROHFIT, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not use the App.

  1. Acceptance of Terms

By downloading, installing, or using ROHFIT, you acknowledge that you have read, understood, and agree to be bound by this Agreement. You also affirm that you are at least 18 years old or have obtained the necessary parental consent to use ROHFIT.

  1. Privacy and Data Collection

PATHFINDER LP is committed to protecting your privacy and maintaining the confidentiality and security of your personal information. By using ROHFIT, you acknowledge that the Company may collect, store, and process your personal data, including but not limited to contact information, health data, and social media data, in accordance with applicable privacy laws and regulations.

  1. Collection and Use of Data

The Company collects personal information and data for the purpose of providing you with a personalised experience, improving ROHFIT’s features and functionality, and connecting you with wellness professionals. The data collected may include, but is not limited to, your name, email address, date of birth, health information, and social media account details.

 

  1. Legitimate Data Collection

The Company ensures that all data collection is carried out in a legal and legitimate manner compliant with the applicable local laws. By agreeing to use the App, you grant ROHFIT permission to collect, store, and process your data as described in this Agreement.

  1. Right to Withdraw Consent

You have the right to withdraw your consent to the collection, storage, and processing of your data at any time. If you choose to withdraw your consent, please note that certain features of ROHFIT may no longer be available to you.

  1. Right to Object

You have the right to object to the processing of your data for specific purposes, such as marketing. If you wish to exercise this right, please contact us using the information provided in Section 7 (Contact Us).

  1. Profiling

By providing data to PATHFINDER LP, you acknowledge and agree that the Company may use your data for profiling purposes to enhance your personalised experience within ROHFIT.

  1. Protection of data

Though Company encrypts and performs regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Website/Mobile Application. You agree that the Company shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against the Company arising from any such loss or corruption of such data.

  1. User Obligations

When using ROHFIT, you agree to the following obligations:

  1. Legal Capacity

You must have the legal capacity, and not be a minor in the jurisdiction of your residence. If a minor is accessing the Mobile Application, they must show a proof of parental consent when sought by the Company.

  1. Accurate Information

By using the Products or Services You warrant that all the data provided by You is accurate and complete and that the Minor using the Website has obtained the consent of parent/legal guardian. The Company reserves the right to terminate Your account and / or refuse to provide You with access to the Products or Services if it is discovered that You are under the age of 18 (eighteen) years and the consent to use the Products or Services is not made by Your parent/legal guardian or any information provided by You is inaccurate.

  1. Compliance with Laws and ROHFIT’s Terms of Use

You must comply with all applicable laws, rules, and regulations of India when using ROHFIT as well as the ROHFIT’s terms of use. You shall not engage in any unlawful, fraudulent, or unauthorised activities. Company reserves the right to monitor the Website/ROHFIT, and take appropriate legal action against any user who, in Company’s sole discretion, violates the law or these terms and conditions, including without limitation, refuse, restrict access to, limit the availability of, or disable any such user’s access to ROHFIT or reporting such user to law enforcement authorities;

  1. Security

You are responsible for maintaining the security of your account credentials and any activities conducted through your account. You must promptly notify PATHFINDER LP of any unauthorised use or suspected security breaches.

 

  1. Intellectual Property

The ROHFIT Application and all associated content, including but not limited to text, graphics, logos, images, and software, are the intellectual property of the PATHFINDER LP or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. Provided that you are eligible to use the Website/Mobile Application, you are granted a limited license to access and use the Website/Mobile Application and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. Company reserves all rights not expressly granted to you in and to the Website/Mobile Application, the Content and the Marks. Company’s commercial partners, suppliers, advertisers, sponsors, licensors, contractors, wellness professionals, other users and other third parties may also have additional proprietary rights in the content provided on ROHFIT. You may not modify, publish, transmit, distribute, perform, participate in the transfer or sale, create derivative works of, or in any way exploit, any of the Content or the Application, in whole or in part. When Content or the Applications is downloaded to your computer, phone, tablet or any other mobile device, you do not obtain any ownership interest in such Content or the Application. Modification of the Content or use of the Content for any other purpose, including, but not limited to, use of any Content in printed form or on any other applications or networked computer environment is strictly prohibited unless you receive our prior written consent.

  1. Limitation of Liability

Notwithstanding any agreement or understanding between you and the Company, ROHFIT and its affiliates, directors, officers, employees, agents, and suppliers shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the ROHFIT Application, including but not limited to damages for loss of profits, data, or other intangible losses to the extent permitted by law.

  1. Disclaimer from Liability

PATHFINDER LP cannot guarantee the Website/Mobile Application will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Website/Mobile Application, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Website/Mobile Application at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Website/Mobile Application during any downtime or discontinuance of the Website/Mobile Application. Nothing in these Terms and Conditions will be construed to obligate us to maintain and support the Website/Mobile Application or to supply any corrections, updates, or releases in connection therewith.

PATHFINDER LP reserves the right to change, modify, or remove the contents of the Website/Mobile Application at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Website/Mobile Application. We also reserve the right to modify or discontinue all or part of the Website/Mobile Application without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Website/Mobile Application.

ROHFIT may use cookies or similar technologies to enhance your experience and improve the App's functionality.

  1. Indemnification

User shall defend, indemnify, and hold the Company harmless, including its subsidiaries, affiliates, and all of officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:

  1. User’s Contributions;

  2. Their usage of the Website/Mobile Application;

  3. breach of the Terms of Use or these Terms and Conditions;

  4. any breach of your representations and warranties provided to the Company as set forth in the Terms of Use or these Terms and Conditions;

  5. violation by the User of the rights of a third party, including but not limited to intellectual property rights; or

any overt harmful act toward any other user of the Website/Mobile Application with whom you connected via the Website/Mobile Application. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

 

 

  1. Term and Termination

These Terms and Conditions shall remain in full force and effect while you use the Website/Mobile Application.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS AND CONDITION, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE WEBSITE/MOBILE APPLICATION (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS AND CONDITIONS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE WEBSITE AND MOBILE APPLICATION OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

  1. Amendments to the Terms and Conditions

PATHFINDER LP reserves the right to modify or update this Agreement at any time without prior notice. Any changes to this Agreement will be effective immediately upon posting. Your continued use of the ROHFIT Application after any modifications to this Agreement constitutes your acceptance of such changes.

By using ROHFIT, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
